Preamble
These Terms of Use (hereinafter "TOU") govern access to and use of the FixScan mobile
application (hereinafter "the Application"), available on iOS and Android platforms.
By downloading, installing, or using the Application, the user acknowledges having read and
accepted these TOU without reservation. If the user does not accept these terms, they must
immediately cease all use of the Application.
Article 1 – About the Application
FixScan is an AI-powered mobile application that allows any user to photograph or scan a problem
encountered in daily life in order to receive an automated diagnosis and resolution
recommendations.
The Application covers the following areas in particular:
• Home appliances and domestic devices (washing machines, air fryers, ovens, refrigerators,
etc.)
• Computer equipment and software (error codes, hardware failures, system messages)
• Vehicles (dashboard warning lights, visual anomalies)
• Any other equipment for which visual assistance may be helpful
Article 2 – Access to the Application
2.1 – Access Requirements
The Application is accessible to any individual with a compatible smartphone running iOS (version
14 minimum) or Android (version 9 minimum) and an active Internet connection. Use is restricted to
persons aged 13 or older.
2.2 – Account Creation
Certain features require the creation of a user account. The user agrees to provide accurate,
complete, and up-to-date information and to maintain the confidentiality of their credentials. FixScan
reserves the right to suspend any account that violates these TOU.
Article 3 – Features
3.1 – Free Version
• Limited number of scans per month
• Basic AI-generated diagnosis
• General resolution recommendations
3.2 – Premium Version
• Unlimited scans
• Detailed and enriched diagnoses
• Full scan history
• Personalised and priority recommendations
• Early access to new diagnostic categories
Article 4 – User Obligations
The user agrees to use the Application in a lawful and intended manner. The following are strictly
prohibited:
• Using the Application for unlawful, fraudulent, or public-order-violating purposes
• Attempting to bypass, disable, or alter the Application's security mechanisms
• Reverse engineering the code or algorithms of the Application
• Using bots, scripts, or any unauthorised automated processes to access the Application
Article 5 – Limitations and Disclaimers
Diagnoses provided by FixScan are automatically generated for informational purposes only and
do not constitute a certified professional opinion (qualified technician, certified mechanic, IT
specialist, etc.).
FixScan strongly recommends that users:
• Verify recommendations with a qualified professional before undertaking any intervention
• Never perform operations that pose a safety risk based solely on the AI diagnosis
• Contact emergency services in the event of immediate danger
FixScan disclaims all liability for direct or indirect damages resulting from misinterpretation or incorrect
application of the recommendations provided.
Article 6 – Intellectual Property
All elements of the Application (logo, source code, algorithms, interface, content) are the exclusive
property of FixScan and are protected by applicable intellectual property law. Any unauthorised
reproduction is strictly prohibited.
Article 7 – Availability and Maintenance
FixScan strives to ensure the Application is available 24/7. However, technical interruptions or
maintenance operations may occur. FixScan shall not be held liable for service interruptions and
reserves the right to modify or suspend any or all features at any time.
Article 8 – Amendments to the TOU
FixScan reserves the right to modify these TOU at any time. Users will be notified of any material
changes via the Application or by email. Continued use of the Application after notification
constitutes acceptance of the updated terms.
Article 9 – Governing Law and Jurisdiction
These TOU are governed by French law. In the event of a dispute, and in the absence of an
amicable resolution, the courts having jurisdiction shall be those of the registered office of FixScan.
Terms and Conditions of Sale (T&C;)
Preamble
These Terms and Conditions of Sale (hereinafter "T&C;") govern the commercial relationship
between FixScan (hereinafter "the Publisher") and any user wishing to subscribe to the premium
offer of the Application (hereinafter "the Customer").
Any subscription to the paid offer implies full and unconditional acceptance of these T&C.;
Article 1 – Offers and Pricing
1.1 – Description of Offers
The Application offers a premium subscription (monthly or annual). Available plans and pricing are
displayed within the Application under the "Go Premium" section.
1.2 – Pricing
Prices are displayed in euros inclusive of all taxes. FixScan reserves the right to modify its prices
with at least 30 days' prior notice. Renewal after notification constitutes acceptance of the new
prices.
Article 2 – Order Process and Payment
2.1 – Subscription
Subscriptions are processed directly within the Application through the in-app purchase systems of
the Apple App Store or Google Play Store.
2.2 – Payment Methods
Payment is handled by the relevant platform (Apple or Google). FixScan does not have access to
the Customer's banking details.
2.3 – Confirmation
A subscription confirmation is sent by the platform to the email address associated with the
Customer's account. Premium access is activated within minutes of payment confirmation.
Article 3 – Subscription and Renewal
The subscription is automatically renewed at the end of each period unless cancelled at least 24
hours before the renewal date, directly through the account settings of the relevant platform (App
Store or Google Play).
Article 4 – Right of Withdrawal
In accordance with applicable consumer protection law, the right of withdrawal does not apply to
digital content whose execution has begun with the Customer's prior express consent and explicit
waiver of the right of withdrawal.
By subscribing to the premium offer with immediate access, the Customer expressly acknowledges
waiving their 14-day right of withdrawal.

Article 5 – Refund Policy
Except in the case of a proven defect in the Application, subscriptions are non-refundable once
activated. Any refund request must be submitted to the relevant distribution platform (App Store or
Google Play), in accordance with their respective refund policies.
Article 6 – Publisher's Liability
In the event of an extended interruption of the premium service (exceeding 72 consecutive hours),
the Publisher undertakes to extend the Customer's subscription by an equivalent duration. The
Publisher's liability is limited to the amounts actually received from the Customer for the current
subscription period.

Article 8 – Governing Law
These T&C; are governed by French law. Any dispute shall be submitted to the jurisdiction of the
French courts.
